Justicia por la muerte de Facundo Cabral

By Mike McDonald

GUATEMALA CITY | Sat Jul 9, 2011 4:30pm EDT
(Reuters) - Argentine singer Facundo Cabral, one of the stars of Latin American folk music, was shot dead in Guatemala City early on Saturday when gunmen riddled his car with bullets, authorities said.

Cabral, who rose to fame in the 1970s as a protest singer, was on his way to the airport when three vehicles boxed in his white Range Rover and opened fire, killing him and injuring his driver, Guatemala's Interior Minister Carlos Menocal said.

Police earlier said the driver was killed.

Born to a poor family in 1937, the outspoken Cabral was best known for his 1970 song "No Soy De Aqui, Ni Soy De Alla," ("I'm Not From Here, I'm Not From There Either") which was covered by many other artists including Julio Iglesias.

Cabral went into exile in Mexico during Argentina's 1976-1983 military dictatorship. His songs later turned more spiritual and he continued to fill concert halls across Latin America. He had been in the Central American country on tour.

Argentine television stations interrupted their broadcasts with news of the 74-year-old singer's death.

Guatemalan president Alvaro Colom vowed swift action.

"We will find these criminals and bring them to justice," he told Argentine radio.

Colom said he spoke to Argentine President Cristina Fernandez to offer his condolences for the killing, the motive for which was unclear. Guatemala, one of the region's poorest countries, has one of Latin America's highest murder rates.

Guatemalan authorities said the gunmen peppered Cabral's car with 18 bullets in an exchange of fire with the singer's security detail, which was in a separate vehicle.

His driver, businessman Henry Farina, was injured, along with one person from Cabral's security detail. Enrique Vaca Narvaja, Argentina's consul to Guatemala, told Argentine television Farina may also have been a target.

Cabral was mourned by fans across Latin America. Argentine Foreign Minister Hector Timerman paid tribute to the singer.

"The murder of Facundo Cabral in Guatemala brings us great sadness," he wrote on his Twitter account. "Adios amigo!"

Venezuelan President Hugo Chavez followed suit: "We are weeping with Argentina."

Edgar Palacios, 54, a fan in Guatemala City, said the singer would not be forgotten.

"Facundo Cabral died but his music will never die, just like John Lennon died but his music never died," he said. "Cabral wasn't just from one country. He was a universal man."

Guatemala has been racked by incursions from Mexican drug gangs, notably the brutal Zetas cartel.

Colom has struggled to contain the violence and Cabral's murder is an embarrassment to the president just two months before a first round of presidential elections which polls show his center-left National Union of Hope party (UNE) may lose. Colom himself is barred by law from seeking re-election.

CLEMENCY for RICHARD DIGUGLIELMO

OVER 1200 + SIGNATURES ON 1st PETITION
to view 1st petition click here: http://www.richarddiguglielmo.org/sign-letter/name-list-1

LETS GET THIS 2ND PETITION EVEN HIGHER

THE COALITION OF LAW ENFORCEMENT, LABOR UNIONS, CONCERNED CITIZENS FOR THE RELEASE OF IMPRISONED NYPD OFFICER RICHARD DIGUGLIELMO

We are requesting your support for a clemency application of Richard DiGuglielmo, a veteran of the New York Police Department who was convicted of depraved indifference murder after a series of tragic events in which Officer DiGuglielmo shot and killed a man who had struck Officer DiGuglielmo's father with a metal baseball bat. Additional information about Officer DiGuglielmo and his case is available at http://www.richarddiguglielmo.org/

As you may know Officer DiGuglielmo was convicted of a murder stemming from a 1996 off-duty incident where he effectively saved his father's life. A New York State Supreme Court Justice subsequently released Officer DiGuglielmo in 2008 only for Officer DiGuglielmo's conviction to be re-instated after 20 months of freedom by a NYS Court of Appeals decision. A recent and probably final decision by the United States Court of Appeals has affirmed the NYS Court of Appeals decision. In the courts opinion they effectively stated that Officer DiGuglielmo's gun was a more serious threat than the baseball bat used to strike his Officer DiGuglielmo's father with TWICE! The court further opined, that Charles Campbell lacked intent to use the baseball bat as a deadly weapon because he never struck DiGuglielmo Sr. near the head or other vital area!

Article 35 of the NYS Penal Law effectively states: A person may use physical force upon another person when and to the extent he or she reasonably believes such to be necessary to defend himself, herself or a third person from what he or she reasonably believes to be the use or imminent use of unlawful physical force by such other person.

In People v. Talbert, the court held that an object as ordinary as a broom handle could be considered a weapon under the Penal Law if there exist the requisite intent to use the object unlawfully against another. The object in question was a broom handle…in Officer DiGUGLIELMO 'S CASE IT WAS A METAL BASEBALL BAT!

We have effectively come to a point of critical mass in relation to this case. The rulings by the NYS and Federal Appeals Courts in relation to this case have enormous ramifications nationwide for Police Officers, Peace Officers, and Citizens who may have to use deadly physical force. At this point there are no legal options left. We need your support in our effort to petition the NYS Governor Andrew M. Cuomo for clemency. We eagerly await your response.

ACT NOW….

SUPPORT the APPROVAL of Findme2 to search for HEATHER ELVIS!

IMPORTANT UPDATE, MAY 17, 2014
UPDATE ON PETITION == NOT ACCEPTABLE CHIEF RHODES AND CHAIRMAN LAZERUS! (LETTER FROM CHIEF RHODES AND REPLY TO CHIEF RHODES AND CHAIRMAN LAZERUS!)

Ms. Cherry,

Thank you very much for your interest in assisting the Horry County Police Department in this case, however at this time we are not requesting the assistance of Findme2. The Horry County Police Department is currently using the services of another search and rescue agency and we actually have established relationships with two search agencies.

We have previously searched for Ms. Elvis by land, air and water in all areas that we had reason to believe that she may be located; without additional information I do not believe that another search is currently necessary.

When we do receive additional information it is likely that we will contact the agency that has already been assisting us with this case; however if they are unavailable I will most certainly reach out to the Findme2 agency for assistance.
Again thank you very much for your desire to assist and should we need any volunteers in the future I will reach out to you as well.

Saundra Rhodes
Chief of Police
Horry County Police Department
(843)915-5350
-------------------------------------------------------------------------

Chief Rhodes, (and members of the Horry County Council),

I do applaud you for your quick response, but I must inform all of you, your answer is not acceptable by any means! This would not cost you money, yet you refuse to let 'findme2' come there and use their 'tools' to search the areas and terrain they feel she may be.

My understanding is they bring their own team in, they do not need assistance 'physically' from 'your law enforcement team', only someone to 'verbally communicate' with during the massive search they will commit to, and it is very common, that people have been found in the same areas that have been previously been searched!

The 'residents' of Horry County, the 'vacationers' that come to 'Myrtle Beach' from 'around the world', have 'proven' their desires to have this team come there and try 'their' approach' to find Miss Elvis!!! If this was your child, Chief Rhodes, your child Chairman Lazerus, you would NOT be so quick to dismiss a professional team of search and rescue to aide in finding your child, and the fact 'they will absorb the cost, because 'they believe' they 'can accomplish what your other outside teams have eluded them', there is simply no excuse to say no!

I have mailed you the comments yesterday by your residents and some from around the world, they are also 'baffled' by your' quick dismissa'l of this 'free search'. "Not acceptable Chief Rhodes", "not acceptable Chairman Lazerus"!

The petition will go on, and other legislatures 'will' be called into play. When the elections come up in December for Chairman Lazerus, you just may be surprised how many residents will remember you 'not' helping to make this happen! They will remember the ones who stood up for them!

Most sincerely, Barbara Cherry

**A FEW TESTIMONIALS FROM FINDME1**
**Kelly; Thank you for all your help with our missing person in the City of Perry, Kansas. Our victim Mr. Shawn Fowler was found about an eight of a mile from his home. He was found floating in the Delaware River within 100 feet of one of the GPS readings your team provided. He was found at approximately 1345 hours on March 19,2009. The river had been searched a couple of times by boat and scanner with no results the day prior to the body coming to the surface. Part of the information we concentrated on was the area around a submerged tree as predicted by one of your Team members. I have shared your Team efforts with Deputies, Firemen and Medical persons who assisted in the three month long search. Again THNK YOU … THANKS TO THE TEAM !!!! The Family now has closure! Respectfully: Ramon C. Gonzalez, Jr. Police Chief

**“I can’t begin to tell you and the whole group what your service has meant to all of us that love Ed or begin to know what it would have been like to not have your group involved. I truly believe that without your group the time frame in which he might have been found – if ever. After speaking with Kristi (AZ- Search & Rescue) and Kelly (FIND ME) I went from frustration and feeling hopeless to having comfort that a group having the capability and resources cared and would do everything you could to find him. And you did. What heroes you all are.” Rhonda Younger

**Dear Kelly, My family wished to express our appreciation for the support and commitment you and the “Find Me Group” gave us during the search for our daughter. Meeting with you and your group, feeling the concern and caring expressed, helped us through a difficult time in our lives. The ending of the search was not what we had hoped for, but we were able to bring Marcy home and we are grateful to have her with us once again. Sincerely, Lynda Randolph

*******UPDATE******* FOR THIS PETITION** MAY 8, 2014

ON MAY 7, 2014, THIS PETITION WAS MAILED TO THE HORRY COUNTY COUNCIL MEMBERS AND GOVERNOR NIKKI HAYLEY. THIS PETITION WILL STILL REMAIN ACTIVE!

I HAVE GIVEN THE MEMBERS OF THE HORRY COUNTY COUNCIL **ONLY 7 DAYS** FROM RECEIPT OF THIS PETITION TO IMPLEMENT THE FINDME2 TEAM TO ARRANGE COMING TO HORRY COUNTY AND BEGIN THE MASSIVE SEARCH FOR HEATHER ELVIS!

I HAVE ALSO NOTED TO THE MEMBERS THAT THE RESIDENTS OF HORRY COUNTY *DEMAND* THESE MEMBERS TAKE **IMMEDIATE ACTION**; REFUSAL TO DO SO COULD RESULT IN THE DISAPPROVAL OF THEIR CANDIDACY IN THEIR RESPECTIVE, UPCOMING ELECTIONS! IF YOU ARE **NOT** REGISTERED TO VOTE, NOW WOULD BE AN APPROPRIATE TIME TO REGISTER! YOU CAN *ALL* MAKE A DIFFERENCE! *EVERY* VOTE COUNTS!! EXECUTE YOUR VOTE WISELY! YOU *WILL* BRING CHANGE TO *YOUR* COMMUNITY!

---------------------------------------------------------------------------------------

The residents of Horry County and friends around the Country, wish to implement the FINDME2 professional search and rescue non-profit group to search and recover Miss Heather Elvis.

The Findme2 search and rescue team have many assets to utilize during their searches, such as search management, multi disciplinary search coordination, ground search teams, canine search teams, (findme2 has teamed up with Arizona Search Track & Rescue (AZ-STAR) AZ-STAR provides to the public 'free of charge' trained air scent, trailing and cadaver dogs to assist law enforcement in locating missing persons. AZ-STAR accuracy is 100% when the target victim is located anywhere in the search grid regardless of the terrain),air search teams, dive teams, aerial surveillance photos, and 'over 100 vetted intuitives' world wide.

Because this will 'NOT' cost the County any additional money, because of their '100% success rate' with their 'canine search team' within their 'search grids', and BECAUSE the recovery of Heather Elvis has so far ELUDED any previous searches, we believe it is the RESPONSIBILITY of the County Of Horry Council Members to ISSUE the Findme2 Group 'APPROVAL' to search for Miss Elvis, and as a professional team, will work with the Horry County Investigations Team to ACHIEVE A SUCCESSFUL RECOVERY OF HEATHER ELVIS.

On the 15th April 1989 I was in one of the few ambulances allowed on the Sheffield Wednesday football pitch. I was not called to give evidence to the Taylor inquiry in 1989/90. I will be required to give evidence at the new inquest into the deaths of the 96. South Yorkshire Police, Yorkshire Ambulance Service, Sheffield City Council and I have all been awarded Interested Person status. This status, amongst other things, allows an opportunity to have legal representation at the inquest.

While the Police Authorities, the Ambulance Service and the City Council will have their legal teams paid for the taxpayer, I currently have to find every penny of my legal costs.

Ambulance Service staff involved with the disaster have been offered general representation by the Ambulance Service Lawyers but as this is only to serve the interests of the Ambulance Service it will inevitably act as a way to gag me. I cannot sit alongside the Ambulance Service Managers as I am one of their biggest critics. I should not be silenced by not being able to afford advice and support.

Woman Brutally Tortured and Left to Die - Moist Eyes Awaits Justice

On 22nd November, 2013 she boarded a vehicle to pick her 6 year daughter up from the school. Four men present in the vehicle attempted to rape her. The initial news that surfaced suggested that she was raped. However, the autopsy report counters this claim.

Despite this fact, the condition in which her body was found suggests that there might have been attempts to gang rape her. The brutes, having failed to succeed in their evil desire, brutally tortured the girl and inflicted severe injuries on her head and neck. She was finally thrown out of the running vehicle merely 100 metres away from the nearest police station. Everything happened in broad daylight.

There seems to be inefficiencies in the police investigation. The vehicle where the crime was reportedly committed has still not been located. The incident happened in a small district town of Lakhimpur in Assam and a few such vehicles operate in the area. There is crucial forensic evidence in the vehicle and delays in locating it risks the evidence being destroyed. It has been more than 10 days now and no credible arrests have been made.

The Assam Police is coming out with various possibilities of murder and accident to cover up for its gross failure to make any credible arrests and locate the vehicle. They have also resorted to Character Assassination based on the statement of a person that was arrested and then later released. It can only be hoped that the Assam Police has not forced the person to confess having illicit relationship with the deceased. Assam has witnessed quite a number of such incidents in the past. The repeated failure of the government to deliver justice in the wake of the elections ahead seem to put the police under tremendous pressure to make the case look like an accident or a murder. The possibility of a political puppet investigation cannot be ruled out. The Special Investigation Team (SIT) constituted by the government seems to be running a puppet show.

Even if it was a planned murder, it is imperative that the culprits are apprehended. The fact that her injuries were very horrendous cannot be ignored and such a horrific crime cannot be tolerated. Failure to nab the culprits will simply mean encouragement to other anti social elements.

The incident was widely covered by press and media.

Deny Parole of a Murderer - Frank Moniz

RE: Frank Moniz Case ID: P1-1990-3261A

On July 27, 1992 Frank Moniz was sentinced to Life in Prison with the possibility of parole for one of the cruelest murders on Rhode Islands record, for the murder of his estranged wife Marellen Medeiros on August 20, 1990. She was just 24 years old.

You may not know me but my name is Elizabeth (Medeiros) Rivera, I am one of Maryellen's sisters. Five years ago, Frank Moniz's case was reviewed for possible parole for the first time. We as a family, fought for his continuence to stay incarcerated. The parole board at the time reviewed his case and noted to extend his stay at the ACI. Now, once again the time has come for my family as well as myself to fight and speak out on behalf of family, friends, concerned citizens and for my late sister Maryellen to keep Frank Moniz from being given the possibility of parole on October 22, 2012. It is in everyone's best interest, to keep this man Frank Moniz incarcerated for the remainder of his natural life.

I truely believe that Frank Moniz has no remorse for his actions that took place on that day in August of 1990. Frank Moniz, premeditated going to Maryellens apartment house with nothing but "MURDER" on his mind. Frank Moniz proceeded to ring Maryellens door bell at her apartment and tell her that she had mail so she would let him in. As Maryellen proceeded to open the hallway door, her estranged husband took out a knife that he hid in a bag under his arm and began stabbing defenseless Maryellen over 50 times with a nine inch kitchen knife. Frank Moniz stabbed Maryellens back, legs, face, chest, arms and hands. These stab wounds that he so inflicted were of such force that some wounds were with bruising. However, with Maryellen being athletic in stature, attempted to give back the fight for her life. Her hands had "Defence Wounds", wounds that showed she put up a fight, but there was no winning when your fighting with a savage beast like Frank Moniz holding a knife. Dear God, One can only imagine what was going through Maryellen's mind as she laid there bleeding and fighting for her life.

So you see, it is my opinion and fear (as also for many of us) is that if this Monster named Frank Moniz was to be released, that he would attempt, once again, to contact my parents. Even if he was to move out of state, the fear would still be present for they still have the same phone number and address for over 50 years now.

Please, please help us keep Frank Moniz incarcerated. Help us make sure that he can not and will not do this to another family ever again. Frank Moniz has no regard for life, love or family. He places no values on life for if he did, Maryellen would still be here with us today with possible children of her own but that too was all taken away by him, as he left her lying there to die... He called her his "LOVE"...I don't think so! I can not imagine Frank Moniz being an asset to our society. He has proven nothing but how heartless and dangerous he really is.

Thank you for your assistance and support,
Elizabeth (Medeiros) Rivera, family, friends and concerned citizens.

Iranian Judiciary Must Reverse American Citizen’s Death Sentence

9 January 2012

The International Campaign for Human Rights in Iran said today that Amir Hekmati, a US citizen, has been sentenced to death by the Iranian judiciary.

A source close to the family told the Campaign that the US citizen entered Iran for the first time on 15 August 2011 to visit with his family members. He was arrested on 29 August 2011 on charges of espionage.

“When Amir supplied his background and applied for his passport processing at the Iranian Interest Section of the Pakistan Embassy in Washington DC, he was assured that his prior employment with the US government was not going to impede his trip to Iran nor cause him any problems,” the source added.

Four months after his arrest in August 2011, Hekmati’s first court session was held on 27 December at Branch 15 of the Tehran Revolutionary Court. Presiding Judge Abolghassem Salavati denied Hekmati the lawyer hired by his family to represent him. Instead, a court-appointed lawyer represented him during the trial without ever seeing him beforehand.

Judge Salavati is one of Iran’s most notorious judges, well known for the unlawful and harsh sentences he has delivered to dozens of political prisoners during the post-election show trials. He has sentenced more than one hundred political prisoners, human rights activists, and peaceful demonstrators to lengthy prison sentences as well as at least nine execution sentences, earning the moniker “The Judge of Death.”

Over the past few years a number of Iranian-Americans who have traveled to Iran have faced similar charges, from undermining the Islamic Republic to spying for American agencies. In all such cases the defendants have been released after a few months and have left the country.

“Almost all the elements of Hekmati’s case fall into a classic pattern of Iranian intelligence’s spy-finding machine,” said Ghaemi.

The source close to the family told the Campaign that over the course of Hekmati’s arrest, Iranian authorities pressured them not to talk with the media, assuring the family they would release Hekmati soon. During his arrest and subsequent detention, Hekmati was never allowed to contact his family in the US.

According to state-operated Fars News Agency, Hekmati allegedly entered Iran with the aim of penetrating the country’s intelligence system. Further examination, according to a report by the Judicial-Legal Director of the Intelligence Ministry’s Espionage Unit, indicated that his goal was to accuse Iran of involvement with terrorism. His indictment alleged that Hekmati was recruited by the CIA in May 2009 to carry out espionage missions in Iran.

The family asserts that what was said in the indictment regarding Hekmati’s background, his prior service in the US military and his prior employment with the US government, is in the public record and he never hid what he did in the past. All the information regarding his background could be obtained from his passport application, as well as from his resume, easily accessible from his confiscated laptop.

Breaking their months-long silence, Amir Hekmati’s family issued a statement on 3 January 2012, asserting, “We have been asked by Iranian authorities to remain silent, and were told that Amir would eventually be released soon. After ... reports that a verdict is imminent we can no longer remain silent.”

Rather than release Hekmati without charges, on 27 December Iranian authorities televised a pale and emaciated Hekmati confessing to the charges. Today, 9 January 2012, Hekmati has been sentenced to execution.

“It has been 126 days since Amir Hekmati was detained by the Iranian government after having been granted permission by Iranian authorities to enter to visit his beloved family,” the family said in their statement from 3 January 2012. “[W]e believe the allegations made against Amir are false and believe that the purported confession was not voluntary and was made under severe duress.”

“The judiciary has claimed Amir Hekmati is a spy, citing evidence that only they are aware of,” said Ghaemi. “That evidence should be made public and the judiciary should be completely transparent. If such an accusation were based on credible evidence, there would be no reason to hold his trial without adequate due process.”
