      <title>PETITION FOR DISMISSAL OF THE NWS BOARD</title>

      <description><![CDATA[<p>TO FELLOW PARENTS<br />
NAIROBI WALDORF SCHOOL.                                 5th May 2017.</p>

<p>PETITION FOR SGM 8th May 2017 for DISMISSAL OF THE BOARD</p>

<p>We are calling for a Special General meeting (SGM) on 8th May 2017, the dismissal of the Board and election of an Interim Board to hold fort till 17th June when the AGM will be held. This petition is based on how the current Board has handled matters related to TSC Compliance of our teachers, and their failure to acknowledge and/ or take recommendations provided by parents. We are not advocating the school remaining non compliant. We advocate that the school retain the teachers AND become compliant.</p>

<p>The Board has acted in a manner calculated to put the school at risk, as:</p>

<p>1.       On 10th February 2017, the Board, with reference to section 23 (2) of the TSC Act 2012, issued termination letters to 6 Primary School teachers because they had not yet completed TSC compliance procedures.</p>

<p>2.       On 20th March 2017, the Board, with reference to a High Court Judgement from 2014, obtained waivers for TSC registration for non-compliant Kindergarten Teachers. This judgement was pursuant of section 23 (2) of the TSC Act, 2012. It was not a newly gazetted law that allowed an exception for Kindergarten teachers.</p>

<p>The Board has treated 2 groups of teachers to whom the same law applies, selectively, thus laying the School open to suit of law at the labour court.</p>

<p>The injustice of the decision to terminate these teachers, and the Board’s inflexibility about parents’ and teachers’ requests to let the teachers finish the term, are even more serious in terms of damage to the community. Requests were made in parents’ meetings on 25th and 26th April 2017.</p>

<p>3.       On 21st March, 2017, the School Manager issued a letter to parents on behalf of the Board claiming that the above High Court Judgement was a new directive from the Ministry of Education. The Board was fully aware that the Court judgement was not a new law, but a 2014 jurisdiction argument between TSC and the Council of Governors. Thus we believe that the Board and Manager knowingly lied to parents in pursuit of a private agenda to dismiss teachers. Four teachers remain at risk of losing their jobs on May 10th, 2017.</p>

<p>4.     The ECD waiver received on 21st March applies to the Class 2 teacher also but her notice has not been withdrawn.</p>

<p>5.       On 4th May 2017 in a mediation meeting with parents of affected Primary Classes, the Board declined to take action to protect the school by obtaining TSC waivers for the Primary teachers or withdrawing their termination letters with immediate effect. TSC cannot issue a waiver without a request from the school. We believe this request has never been made, despite claims otherwise from the Board. When a simple oral request was made by the School Manager re Kindergarten teachers on 20th March, the waiver was immediately availed by the regulator, and the same would obtain for affected Primary teachers.</p>

<p>We are not advocating the school remaining non compliant. We advocate that the school retain the teachers AND become compliant.</p>

<p>6.    Board members have been threatening and intimidating staff who talk to parents,  in clear violation of the Board Charter. This creates an atmosphere of mistrust and unnecessary tension among staff whose primary duty is to  nurture our children. Section 5.1 of the Board Charter states that Gathering and Sharing information are primary roles for all employees.</p>

      <title>Stop the expulsion of CCPC from the Madrassa Hall. It belongs to the community.</title>

      <description><![CDATA[<p>The Committee members of the Pangani Mosque & School Association have decided to expel CCPC (Community Policing Project in exsistence for 15 years now) from its current location at the Madrassa premises.</p>

<p>Although their letter claims that they require space to build more Madrassa class rooms here, these committee members have personalized the issue and have decided to expel us from here for reasons that you will be shocked to hear about.</p>

<p>The fact is that they want us to tow their rope, and follow their every command. They want us to participate in their personalized religious functions.</p>

<p>They do not understand that CCPC is an organization that will operate and serve people of all communities, irrespective of color, creed and religious beliefs. Even if we are located at the Madrassa hall, we have a duty to serve all other citizens within the area.</p>

<p>Not attending any religious functions is being taunted as one of the reasons for removing us from there. They believe that we are not praying at their mosque, hence we should not be allowed to operate from their Madrassa.</p>

<p>They have tried to keep some of the people who are very long time area residents, (and also happen to be CCPC members) from joining the Pangani Mosque & School Association by revoking their memberships right from the doorsteps of the Registrars office. They have tried to sabotage us by trying to allegedly plant on us perverted allegations. Don’t you wonder why ?</p>

<p>Dear resident, please note that only 2 members of the Pangani Mosque Committee are residents of the area. The rest are all well to do people from outside areas. How can their interest lie in your security? Obviously they don’t benefit from CCPC. But what about you the residents !!  They are not interested in how it affects you !! They don’t what to know what happens to your family, your sons, daughters and your friends. When thugs strike at night, these people will not be there to help you. CCPC has been instrumental in preventing crime in the area for the last 14 years now. We have once again purchased a vehicle to patrol the area at night with the Police officers. The Kenya Police has always been in the fore front to assist us.</p>

<p>CNN/CCPC has been instrumental in distributing relief food, items, clothes, shoes etc to the poor of the area and beyond. We have been instrumental in providing you the residents with 2 free medical camps in the last 2 years. We have been instrumental in conducting the 1999 Population Census (Starehe Constituency) right from this very location.</p>

<p>Remember how we provided Police security for the Census people, and also those that were actually coming into your premises for filling in the necessary census information from you. It has taken us quite a lot of time, effort and money to come up to this level.</p>

<p>It will be very much unfair to this area if these few non-residents of the area decide not to have CCPC operating from here, for their very personnel reasons.</p>]]></description>

      <title>Register Madaraka Party of Kenya</title>

<p>The "Register Madaraka Party of Kenya" Petition to be sent to "H.E President Mwai Kibaki, Attorney General Amos Wako, and Registrar of Societies"</p>

<p>Madaraka Party of Kenya was formed on June 11, 2005 to champion for the rights of youth, unemployed, poor workers, and peasants. On July 15, 2005, Madaraka Party submitted application for registration to the Registrar of Societies, Nairobi, Kenya.</p>

<p>On January 20, 2006, the Deputy Registrar informed Madaraka officials that "the government has put on hold registration of all political parties till further notice."</p>

<p>On January 29, 2006, the party wrote to the registrar seeking the following information:</p>

<p>1. "Who or which office in the government made the decision to put on hold the registration of political parties in Kenya?</p>

<p>2. Why has the government decided to put a hold on registration of political parties?</p>

<p>3. For how long will the hold be in place?</p>

<p>4.  What is to happen to trigger the lifting of the hold on registration of political parties?</p>

<p>5. Under which law has the government based its decision to put on hold registration of political parties? Lastly, Is Kenya still a multiparty democracy or democracy is also on hold till further notice?"</p>

<p>There has been no response as of February 17, 2006.</p>]]></description>
