URGENT!! Break the Silence Against Children Coerced Marriages In Zimbabwe

Child marriage is a violation of children fundamental human rights. In Zimbabwe, girls as young as 10 are married to old men every day.
Rutendo, now 16, mother of 2, was forced into marriage to Madzibaba Japhrey (39 years) at the age of 10. She had her first child just before her 14th birthday. She is the third wife in a very poor family.
We met her through her relatives, as these children (wives) are not allowed to engage with strangers. A family member called on us to help get this child (wife) released to them. A local leader of the Apostolic church, Vapositori, as widely known told us she could not be released because their spirit has given her to this old man. Like any other cult, there are threats traded against the victim if she dares leave and sadly these kids believe. In this case, we were told that if she disobeys their God instructions to marry this old man, she is doomed and cursed for ever.
The Zimbabwe marriage Act is discriminatory against girls. The Marriage Act allows girls minimum age 16 to marry while the minimum age for boys is 18. The Customary Marriages Act is silent on a minimum age of marriage. In January 2016, the Zimbabwe Constitutional Court ruled that the Marriage Act, which allowed girls as young as 16 to be married with their parents’ consent, was unconstitutional and recognised 18 years as the legal minimum age of marriage. Zimbabwean authorities are still to amend or repeal all existing marriage laws that still allow child marriage.

Note! Children are minors and can not enter into marriage agreements and neither can they consent to sexual abuse.

The future of millions of girls depends on government ensuring the court’s ruling is quickly and fully implemented. In the interim, the government should ensure that structures are in place to implement the court’s decision and ensure that girls under 18 are not being coerced into marriage. Child marriage in Zimbabwe, just like in most societies across the world, predominantly affects girls who live in poverty and in rural areas. The less education a girl has, the more she is likely to marry during her childhood.

Women’s Coalition of Zimbabwe (WCOZ), a representative of non-partisan women’s rights organisations and activists launched # Section 56 Campaign on Saturday the 8th of April 2017. CS56 is a Women’s Rights Activists campaign being coordinated by WCoZ to amplify the diverse voices of women’s rights activists in Zimbabwe, who after 3 years of a new progressive constitutional dispensation find that women’s day today lived realities have not changed and their demands for legal and administrative reforms continue to meet a myriad of excuses from various duty bearers.

The launch is a Women’s March titled #Section56March. The aim of the march is to amplify women’s voices in demanding for the full implementation of equality as covered in the Zimbabwean Constitution #Section56 on Equality and Non-Discrimination. The campaign will be speaking to issues of;
1. The failure to change of state practice toward women
2. The de-prioritisation of women
3. The deepening of marginalisation of women

A recent exercise conducted by the country's oldest university showed that 47 percent of students who underwent testing and counselling tested HIV positive.

This follows reports that Midlands State University students' reckless sexual behaviour had been singled out as a major driver of the HIV prevalence rate from 20 percent in 2014 to 23 percent last year. IMC has taken an initiative to encourage students to practice safe sex.

Stop polling station based voters' roll

The introduction of polling station based voters roll is open to abuse by political parties who will use this to intimidate or victimise voters if polling does not go in their favour. Since a polling station has fewer voters on its roll than a ward it would be much easier to identify those who would have cast their vote and how they would have voted.

Recent Norton by-election is a case in point. There was rampant intimidation and threats from senior party politicians. What will happen if those who have high hopes to win lose? Some parties are yet to embrace democratic practices especially in the rural areas where divergent views are not tolerated. The "sellout" mantra is still being used 36 years after the end of the war.

Tomana Must Go

The statements of the Prosecutor General Johannes Tomana where he advocates for poor children from the age of 12 to be legally permitted to consent sexually and get married, grossly violate the rights of children enshrined in the Constitution of Zimbabwe and International Instruments Zimbabwe is party to.

The Prosecutor General has proven beyond reasonable doubt that he is not suitable to continue as Prosecutor General.

His duty is to protect the weak and vulnerable and such statements trample upon what his office should protect.

The Prosecutor General should with immediate effect resign or be forced to resign as he no longer retain the confidence and trust of the general Zimbabwean populace.

Stop Sexual Harrassment Against Women in Zimbabawe

It is with a heavy heart and insurmountable sadness that DPZ has learnt of the shameful and horrific incident circulating on social media in video format involving a group of touts as they unleash violence and outright sexual harrassment on a young lady because of her dressing.

https://www.youtube.com/watch?v=DwpO7GAnjJU

While DPZ understands the frustrations in the country emanating from the failed economy, economic hardships and overall political disillusionment, the aggression and anger on an innocent young lady is misdirected, irresponsible and a downright disregard of her rights and dignity.

This act and any other acts of violence against women should be categorically castigated with the contempt they deserve. These acts do not belong in a civilised and democratic society which the DPZ aspires to build for a good and prosperous Zimbabwe.

DPZ welcomes the whispers that the police are investigating this incident and hope that it is not simply a public relations stunt. It is our hope that all the perpetrators meet the full wrath of the law. We urge the investigating officers to have a gendered perspective on this disgusting incident to ensure that the victim of this heinous crime feels safe, protected and secure.

DPZ also urges parliament to pass a bill that will protect women from these and other incidents. This is by no means an isolated incident and it's about time that our parliament shows that as elected legislators, they feel for our women, mothers and daughters and will protect them from violations of their human rights.

We seek a nation that will respect the dignity of every individual and that includes the girl child, our daughters, mothers and all women.
