---------------------------------------------------------------

Radio Free Europe | Radio Liberty

A lawyer and activist close to the case of an Iranian woman convicted of adultery say she may soon be stoned to death, RFE/RL's Radio Farda reports.

Women's rights activist Soheila Vahdati spoke to Radio Farda on June 17 about the case of Sakineh Mohammadi Ashtiani. Ashtiani, who has two children, has been imprisoned in the northwestern Iranian city of Tabriz since 2005.

Vahdati says Sakineh was earlier sentenced to 99 lashes in 2006 for having "illicit relationships." The sentence was subsequently carried out and her case was closed.

But authorities later charged Ashtiani with murder. Prosecutors alleged that Ashtiani and her boyfriend had killed her husband.

In making the murder case against Ashtiani, activist Vahdati says the court "illegally" reopened the adultery case against Ashtiani. It was the second time Ashtiani would be tried for the same alleged adulterous conduct.

According to Vahdati, Ashtiani was sentenced to be stoned to death for the same alleged act of adultery for which she earlier had been convicted to 99 lashes. It is not clear when she was sentenced.

While denying the charges against her, Ashtiani has asked the authorities for a pardon.

According to activist Vahdati, Ashtiani told the authorities, "if I have done any wrong, I repent."

Her clemency request was rejected.

Lawyer Mohammad Mostafaie, who represents Ashtiani, also maintains her innocence. Writing on his personal blog, the lawyer described Ashtiani's stoning as imminent and said his client will be executed "for an offense she has not committed."

According to Article 83 of the Laws of Islamic Punishment in Iran, ratified in 1991, the penalty for adultery is death by stoning.

However, murder is not punishable in Iran by stoning. Murderers who receive the death sentence are hanged.

Save Meriam Ibrahim, Don't Hang her to Death for Her Faith

Meriam Ibrahim is 8-months pregnant and is a Christian woman sentenced to hang to death in Sudan for rejecting Islam. She is being shackled by Sudanese officials despite the fact she is eight-months pregnant.

(MAY 27 UPDATE: Meriam has since given birth to a baby girl named Maya.)

She will be tortured - beaten with 100 lashes for marrying an American Christian. Then she will be hanged for being a Christian. Meanwhile, her son, a 20-month-old boy and American citizen, is also jailed with her and is sick from the prison conditions.

Ibrahim’s husband, U.S. citizen Daniel Wani, said lawyers representing her told Amnesty International that religious clerics in court had asked her if she would recant her faith, but she told them: “I am a Christian.”

The death sentence issued to a pregnant woman who refused to renounce Christianity for Islam in Sudan is an “egregious violation of basic human rights,” Congressman Chris Smith (NJ-04), Chairman of the House congressional panel that oversees U.S. policy in Africa, said previously.

“This is an affront to religious freedom everywhere,” Smith said. “The refusal of the government of Sudan to allow religious freedom was one of the reasons for Sudan’s long civil war. The U.S. and the rest of the international community must demand Sudan reverse this sentence immediately.”

Baltimore Ravens 5 year veteran Cheerleader, Courtney L was given notice she would not be performing with her teammates at the SuperBowl XLVII. The director & front office explained they could only take 32 members of the squad and all 3+ year veterans would be going.

Courtney is a 5 year veteran and the only veteran on the team the coaching staff isn't taking. Courtney was featured in every calendar & chosen to attend many charity venues over the years and she has done every ambassadorial job with pride and class.

She was ranked 57 among 100 hottest Cheerleaders this season & is a featured cheerleader in many print articles.

Courtney announced she was retiring during the last home game at the end of the season which didn't go well with the director. She was told she didn't put in as many appearance hours this season as she did the past 4 yrs while in college. This season she earned her B.S. degree and got a full time job... Bad call. They also stated she struggled with weight on occasion & she had been benched for 2 lb weight gain during a game earlier in the fall, which is a absurd, unhealthy and a complete inaccurate measurement of a woman's "appearance" and size!

Courtney is beautiful & this organization that is supposedly out there to promote self esteem and healthy body image to millions of young girls and women nationwide has done a big injustice to Courtney & we are outraged! She deserves to be out on the field with her teammates, her family.

Since this petition started she was informed tonight Jan 27th to turn in her uniform by the team Director Tina Galdieri. She is no longer on the team because of the out roar we have caused! She needs to be reinstated and allowed to perform with her teammates at Superbowl.

Stop Bale being deported after 13 years serving British Armed Forces

Isimeli Baleiwai known as 'Bale' to his friends is facing deportation from the UK after serving 13 years with the British Armed Forces. Bale is a foreign and commonwealth soldier from Fiji who was recruited by the MOD when he was 18.

He has served in 5 operational tours including Northern Ireland, Bosnia, Iraq and Afghanistan. His wife Kim is British and they have two young children a boy of 3 and a girl of 6; both British. Bale voluntarily discharged from the Armed Forces on June 15th 2012 in order to provide stability for his family.

He applied for British Citizenship in March while still a serving soldier. This was advised to him by MOD personnel because he had served 13 years and had a British wife and children. This was refused on 28/06/2012 by UKBA, Bale sent an 'appeal for review' but recieved a letter from UKBA on 14/07/2012 stating he had until 9th August 2012 to leave the country.

Under changes made to the Rehabilitation of Offenders Act 1973 (ROA) in 2010 disciplinary offences dealt with at the Commanding Officer's discretion can now be equated to a criminal conviction.

Bale was fined in 2011 by his Commanding Officer for fighting with another soldier who instigated the fight. There was no police involvement, no trial, no defence and nor was it impartial. Bale did not know he was being charged with a criminal conviction. He believed this was an 'in-house' disciplinary offence only. He has no criminal record, this offence is only on his military record. There was no court martial. He has now appealed the conviction.

Under the changes made to ROA in 2010 Bale is now defined as a criminal by the Home Office and of not good character to become a British citizen or apply for indefinite leave to remain.

This is devastating for him and his family. It is a breach of Article 6 of the Human Rights Act (1998) and Armed Forces Covenant (2011). It is also inherently racist because the changes made will have no impact on his British Armed Forces colleagues because these military offences are not held on a criminal record. This change only has implications to immigration Law and Policy. The family believe the law and policy is discriminative.

Please show your support for Bale and his family, their lives are in turmoil. Bale has been told he has until the 9th August 2012 to leave the Country.

The Home Office has been using this 'Law' to deport Foreign and Commonwealth soldiers who have been medically discharged as well. This is a disgrace and immoral!

The family are humbled by offers of donations, however Veterans Aid are advocating for our family and others like us. If you would like to donate please donate to them at http://www.veterans-aid.net/

On 26th July Bale won the right to appeal his military offence 'out of time' because it was not in accordance with Article 6. UKBA still do not accept that this means it can not equate to a criminal offence. They granted Bale discretional leave to remain on 30th July. They have stated they will not make a decision on his deportation until the miltary offence is heard in a court of law. This is not a retrial as there was not one in the first place, this is being treated as a new case. Bale currently can stay but with no rights (work, doctor, benefits) he has a job offer but is unable to take it. Veteran's Aid and his wife will now be supporting the family. Bale feels his service has been dishonoured and UKBA are trying to make his family destitute.

----------------------------------------------------------------

Update: On 20/11/2012 Bale was found NOT GUILTY of his summary offence at Colchester Military Court.

On 05/12/12 Bale was informd that the Home Office would be granting him citizenship. The Baleiwai family are overjoyed that this nightmare has finally come to an end. They also hope that this injustice is not repeated again and the new changes in Law prevent innocent soldiers from being deported or denied their rights.

The Baleiwai family would like to say a great Big Thank-you to everyone who has signed the petition and supported them and in by doing so have helped a lot of others who are facing the same injustice. The support has been overwhelming and kept the family going. Despite the challenges of the last 6 months the family feel blessed to have met so many great people on the way and be part of something that has resulted in a change for the better.

Kibaki Must Step Down

The international community is very much aware that Mwai Kibaki and his Party of National Unity (PNU) rigged the December 2007 Kenyan presidential election.

In recognition of this fact, the European Union, Britain, and the United States have refused to recognize the Kibaki government as legitimate.

As members of the international community, we do not intend to allow this blatant act of disregard for the rule of law and for the will of the people of Kenya to go unchallenged.

The list of evidence of election irregularities compiled in this petition contains widely known facts and has been corroborated by various news sources.

1) All polls taken before the election favored Raila Odinga and his party, the Orange Democratic Movement (ODM), with Odinga leading Kibaki by a margin of 4%. A mid-December report by the government's own intelligence service gave Raila Odinga an even larger lead of 8% to 15% over Mwai Kibaki. As the election drew near, the Steadman poll, which is conducted under the leadership of George Waititu, a close friend of Kibaki's, showed Kibaki catching up to Odinga although the total for the three leading candidates added up to 101%.

2) The Kenyan National Commission on Human Rights (KNCHR) reported that Muslim voters, most of whom were expected to favor Raila Odinga, were denied voter cards in the leadup to the election.

3) Prior to the election, Raila Odinga warned that Mwai Kibaki and his party planned to illegally deploy Administrative Police (AP) as poll agents for the purpose of intimidating voters. While Mwai Kibaki originally denied these allegations, subsequent events showed that Odinga was correct--the East African Standard reported that 65,000 APs were in fact illegally deployed to various parts of the country.

4) Prior to the election, the impartiality and credibility of the Electoral Commission of Kenya (ECK) was jeopardized by Mwai Kibaki's control over the appointment of foreign observers. The East African Standard reported that ECK Chairman Samuel Kivuitu had himself accused the Kibaki "government of selectively inviting international observers for the December polls." Member of Parliament William Ruto of ODM also voiced concern, stating that "Kibaki has gone against a precedence that even brought him to power. The President alone has appointed ECK commissioners. He alone has picked foreign observers. When you put these two issues in the wider picture of the run-up to elections, you see we have a reason to doubt the fairness of the coming polls."

5) Early in the election, when Raila Odinga went to cast his vote at a polling station in his constituency of Langata, he found that his name was missing from the poll register. Furthermore, names beginning in 'A,' 'E' and 'O'--traditionally Luo and Luhya names--were missing.

6) Raila Odinga's ODM party firmly secured the Parliament, winning more than 45% percent of parliamentary seats--that is, at least 95 out of 210 electable seats--compared to Mwai Kibaki's PNU party which secured only 37 seats in total and lost 22 of its original 32 seats. The ouster of the majority of Kibaki's cabinet was regarded by many as a bold statement to the degree to which the majority of the electorate had lost confidence in the Kibaki administration.

7) In Garsen, a mob destroyed 35 ballot boxes on suspicion of rigging.

8) One constituency, Maragwa, reported 115% voter turnout.

9) Although voting ended on Thursday, December 27, the announcement of results from some polling stations was delayed for more than two days because:
a) The aforementioned irregularities compelled numerous complaints from candidates of both parties.
b) ECK returning officers from disputed polling stations could not be located by Kivuitu and had turned off their cell phones.

10) Samuel Kivuitu, chairman of the Electoral Commission of Kenya (ECK), himself acknowledged that the delay would have allowed time for these missing officials or others to rig votes. "This is where cooking could be taking place," said Kivuitu.

11) The ECK failed to address the majority of these concerns raised by Raila Odinga, his ODM party, and the general public and proceeded to announce the obviously illegitimate results, thereby failing in its responsibility to the people of Kenya and lending validity to the debacle.

12) After the ECK announced the results, declaring Mwai Kibaki the winner, the East African Standard reported that an ECK officer alleged that there had been "blatant and shameless alteration of documents" primarily by "information technology officials." This officer said that the Coast and upper Eastern provinces were most affected by rigging, but also named the constituencies of Moyale, Laisamis, Saku and Matuga.

13) A Reuters article also quoted an "election observer who asked not to be named" as having "very little doubt" that the election was rigged.

14) Furthermore, before Kivuitu declared Mwai Kibaki the winner, Alexander Graf Lambsdorff, chief European Union election monitor, stated that there was ``a big question mark over the tallying of results.''

15) After Kivuitu declared Mwai Kibaki the winner, Lambsdorff repeated his misgivings. "We regret that it has not been possible to address irregularities about which both the EU and the ECK have evidence ... some doubt remains as to the accuracy of the result of the presidential election as announced today," said Lambsdorff.

16) Lambsdorff has again gone on record as saying that the tallying process lacked credibility.

17) Prior to Mwai Kibaki's secretive swearing in ceremony, the Kenyan government suspended all live television broadcasts. Coverage of post-election violence, including the government's use of armed police in suppressing demonstrators, has therefore been difficult to verify. In view of the above irregularities, this has had the effect of further eroding any semblance of democracy.

18) Finally, tallies reported by the ECK differed from those announced at polling stations and on television news broadcasts. The New York Times reports that, "The European Union said its observers in one constituency last week witnessed election officials announce that President Kibaki had won 50,145 votes, but on Sunday the election commission increased those same results to 75,261 votes."

Taken as a whole, this evidence is more than enough to declare the presidency of Mwai Kibaki illegitimate and to install the legitimate winner, Raila Odinga, into that office.
