STOP THE CUTTING/UPROOTING OF TREES AT SM BAGUIO

The SM Development Corp (SMDC) is set to cut 43 fully grown Alnus japonica trees while also intending to uproot 97 growing pine trees (Pinus kesiya) and 42 saplings virtually sentencing to death a total of 182 trees within the Luneta Hill area where SMDC is found to pave way for another parking lot.

This is is totally unacceptable, and callously insensitive to the importance of trees to the environment and ecology. We protest vehemently this intended act.

It appears that on Oct. 27, 2011, the Department of Environment and Natural resources (DENR granted a cutting, balling and pruning permit to SMDC upon the instruction of a clearance signed by DENR Sec. Ramon Paje on Oct., 2011.

This shows that DENR does not fully appreciate and understand the contributions of these trees which have already grown up in view of the global warming and environmental threats.

By issuing a tree cutting permit, DENR allows itself to be questioned publicly of its worthiness as well as its role as defender of the environment and natural resources. By ruling in favor of tree cutting by a business entity, it is fast losing public support to an already tarnished image.

DENR also shows preferential treatment for business establishments against original inhabitants, locals and residents who have long cared for the environment. Economy at the expense of the environment is greed.

We finds this utterly senseless and call on the immediate stoppage for these trees from being harmed or killed. Please sign now! Let us all work to stop such stupid acts where our environment is sacrificed for financial gain by a few profiteers. Let us stop these tree cutters. Let us save what is left of our beloved Baguio. If our political leaders and agency public servants do not do what is mandated of them, let us show what a citizens' initiative can do. We can do this.

JUSTICE FOR TARA SANTELICES: Better Crime Prevention

See updates to this petition at the bottom of the preamble.

--------------------------------

Tara Santelices, 23 years old graduate of the Ateneo de Manila was shot in a robbery-hold up incident inside a passenger jeep along Felix Ave. Cainta, Rizal. She was on her way home past midnight (August 6, 2008, about 12:30 AM) with a friend coming from a night out on the eve of her 23rd birthday.

Somewhere along a dark stretch of Felix Ave. near Karangalan Village, a man posing as a passenger, pulled a gun and announced a hold-up. The man grabbed Tara's bag. Instinctively, Tara held on to her bag and in the ensuing struggle, the man shot Tara and hit her on the left side of her forehead. After getting the bag of the others, the man jumped off the passenger jeep. Tara's companion, who has never been in that situation asked for help from the other passengers, and told the driver to bring them to the nearest hospital, as blood was already spurting out of Tara's head. But instead of driving speedily to the nearest medical facility, the driver drove as if it was one of his regular trips, even stopping three times to unload a passenger. Of the five or six other passengers, only one bothered to help Tara's friend carry her. The rest just went about their business as if nothing serious happened. In fact some of the passengers even opted to stop the vehicle for them to get off, wasting precious time for medical attention. The driver eventually took them to a small clinic. But even as Tara's companion was talking to a medical personnel in that small clinic, the driver drove-off leaving them to look for a taxi to bring Tara to a better equipped hospital. Tara was given the appropriate medical attention only about four hours later. The police went to the hospital to talk to the witness (Tara's friend) only a day later.

It is the height of apathy and indifference that our fellowmen show no concern about each other specially in such emergency situation as that involving Tara. It is revolting to know that transport drivers whom our lives and safety are actually under their responsibility as paying passengers, do not know what to do or even try to avoid responsibility under such situations. It is also contemptible that the police had to act so late and only after follow-ups by friends were made with higher authorities.

Tara has been lying in bed, in a coma ever since the incident, her skull shattered by a bullet. Her dream of doing humanitarian work with the United Nations has been shattered as well. Chances of her recovery is almost nil. And the family remains tortured and pained seeing their precious child in that condition every day, feeling helpless. They, however, remain strong in their belief that Tara's fate is in the hands of The Lord Almighty and continues to pray for a miracle.

But we are not entirely helpless if we help ourselves. Even as we continue to storm the heavens with our petitions for Tara's recovery, we can storm those here on earth who have the responsibility and the means to stop this kind of violence, to prevent it from ever occurring again, or from happening to us and our loved ones.

Instead of dismissing this incident as one of those that routinely happens in our streets and thinking about immigrating abroad to escape the situation, we can do something more positive and more concrete.

Let us sign the petition below and join the effort to do battle to combat our own apathy, and to exact responsibility from those who took an oath to serve us - the Public.

------------------------------------------------------------------

(UPDATE: On September 15, 2008, it was reported in the local news that the alleged suspect in the Tara Santelices shooting has been killed in an encounter with lawmen in Antipolo City, Province of Rizal, while being pursued by police. He's apparently also a suspect in other crimes including robbing a gas station in the area. A witness to the crime however claims that the man killed by the police was not the real assailant.)

---------------------------------------------------------------

(UPDATE: On July 27, 2009, after valiantly fighting for her life for about 11 months, Tara died of heart failure. She expired around 4 AM. A wake is on-going which will end on Friday night. She will be cremated on Saturday morning August 1, 2009, just 5 days shy of her 24th birthday.)

---------------------------------------------------------------------
(UPDATE: Tara's mortal remains has been cremated on August 1, 2009. An online memorial has been created (http://virtual-memorials.com/main.php?action=view&mem_id=17338&page_no=1) so that guests who were unable to personally go to the wake can send their message of condolence. Photos of the wake may also be seen at http://chitoirigo.multiply.com/photos/album/73/).

KIXEYE GIVE US BACK OUR ACCOUNT, SHOW US SOME RESPECT!

I have been playing KIXEYE Game called War Commander for four (4) months via Facebook until August 13, 2012. My Account was suspended for allegedly cheating on the game. I wrote an email to KIXEYE support as recommended. I inquire and asked questions about how they accused of cheating and what was exactly have I done wrong that the Game developer of War Commander accused of of Cheating. Here's the reply;

Hello Cherry,

We are not able to reveal how we detect cheating, as that would just let the people who develop these cheats know how our security works and how to avoid it. We have firm evidence, though, that your account has been engaged in cheating. Please note that you are responsible for what happens on your account - if you choose to share your account information with another player and that other player cheats on your account, the account will still be suspended.

As we have determined that we will not be reopening this account, we must consider this matter closed, and will no longer be able to respond to support tickets about this account.

If there is anything that we can further assist you with, please do not hesitate to ask.

Best,
Ray

We feel that we have properly addressed your issue. If you would like to provide us with additional information, please reply back and let us know. If you have any separate issues please go to support.kixeye.com/mail and submit a new ticket. Please join us on the forum (forums.kixeye.com) for game discussions, tips & tricks and to ask community questions. "

History:

Ref:MSG0924418

I emailed back again because i was not contented with their response and asked again what have I done that makes them tell I'm a cheater, a certain Mica responded.

"Hello,

Have a nice day,
Mika "

History:

Ref:MSG0930271

Come to my surprise, they are not answering my question and the reply was exactly the same Ray was telling me. I just realized it was a computer generated auto answering who reply to me with random names.

Later that day, I found out that there are people mostly Philippines "Pinoy" players who has the same sentiments with me. War Commander Accounts were suspended because of Cheating.

Personally for me, This is not fair. KIXEYE group should explain to me and tell me what was the rules that i violated, where in fact when I started the game there were no rules and regulations imposed. Until now I do not have an Idea why they accused as Cheater.

They should have explained to us first and give us some time to defend and explained ourselves. And the word suspended, I asked How long will they keep me suspended, but they did not respond but from their emails they said " As we have determined that we will not be reopening this account, we must consider this matter closed, and will no longer be able to respond to support tickets about this account."

This is just not fair for a player like me who spent a lot sleepness nights for the game. I worked hard on it, to reached Level 29 and get those elite prizes in each event. And the word "cheater" is not acceptable.

They should give some respect for me and to other banned players.

In a constitution, "A person is Innocent until proven guity in the court of law or beyond reasonable doubts" They should not accused me just that.

They should give us the opportunity to state the case, explain and be heard before the final decision to suspend is made.

And lastly, The computer generated auto answer emails with random names. They could give at least some decent answers if they have a real human respond to it. We are not robots, we need explanations.

Dialysis Patients' Appeal to PCSO: The Return of Dialysis Assistance

For English version of petition, click http://bit.ly/englishpetitionPCSO

Cancel Tree Cutting, Earth-Balling and Building Permit of SM

Early January this year, Shoe Mart Development Corporation (SMDC) announced it would be constructing a seven storey parking building at Luneta Hill, Baguio City and in the process, will be cutting and earth-balling some 182 Alnus japonica and Pinus insularis trees.

I wrote a petition against this here at http://www.gopetition.com/petitions/stop-the-cutting-uprooting-of-trees-at-sm-baguio.html where more than 7,000 people have already signed including some 15,000 signatories more on hard copies of the petition. It also led to a protest rally, one of the biggest ever in the city of Baguio last January 20, followed by a protest mass, tree planting an tree concert dubbed as Project Save 182 and Pine for Pine, respectively, last February 5, also attended to by thousands of Baguio residents and students

The permit to cut and earth-ball the trees as well as the Environmental Compliance Certificate (ECC) were issued by DENR Sec. Ramon Paje even though there was no public consultation and hearing and proof of the SM project's social acceptability which was in clear violation of the provisions of the Philippine Environment Assessment System. DENR claims that SM has complied with all the requirements but when we wrote DENR to present evidences of the accomplished requirements, it has not done so until this time.

SM is showing it is insensitive to the protests and pleas of majority of the residents. It intends to go ahead and cut and earth-ball the trees, ignoring my scientific explanation that the trees will die even when earth-balled. It is ignorant or not mindful at all of the ecological, cultural and social contributions of the trees to humans and the environment.

The city government of Baguio has already given SM a building permit. Except for a handful, the city council leaders are surprisingly very quiet about the issue, lifting not a finger to save the trees. The mayor said he is powerless. The regional office of DENR says SM has all the right to cut.

The people are forced to ask, who then will help us prevent the cutting? We sought a dialogue with the mayor who said that it is only DENR that can cancel the tree cutting permit it gave and it is only the DPWH that can cancel the building permit released by the city government.

This petition demands then that for the 182 trees to be spared, DENR must immediately cancel the tree cutting permit as well as the ECC it gave SM because DENR erred in judgement, and that DPWH should cancel the building permit because it was wrong to give one.

Remove Travel Ban to Nigeria

The Philippine Government has imposed a total travel ban of Filipinos to Nigeria.

On October 1, 2007, the Office of the Undersecretary for Migrant Workers Mr. Esteban Conejos Jr. sent a directive to Philippine Overseas Employment Administration (POEA) Administrator Rosalinda Dimapilis-Baldoz to ensure the full enforcement without exception on the deployment ban to Nigeria. This is in relation to the meeting on September 27, 2007 presided by Vice President Noli De Castro and attended by officials from DFA, DOLE, OWWA, POEA, NBI, CFO and Ambassador Roy A. Cimatu of the PMEPC citing that the peace and order situation in Nigeria is unstable.

OFWs in Nigeria have done enormous efforts through different channels (phone calls, emails, letters) in a request to review and to lift the said deployment ban. Even the Philippine Embassy in Nigeria thru Ambassador Masarunga Umpa issued a statement on November 7, 2007 that they have requested and recommended the government officials in Manila to remove the travel ban.

The reasons to the petition for the lifting of the said ban are enumerated below:

1. The incidences of kidnapping of expatriates are confined mainly to a small area in Nigeria known as the Delta Region and they happen at remote swampy areas, creeks and lagoons of the region’s two states, Rivers and Delta. However, these incidents are certainly not daily occurrences but rather isolated cases which government security agencies have categorised as criminal activities and are not reflective of the entire security situation of the country.

2. Multinational companies operating in the said region, in cooperation with government agencies, have very stringent and well-planned security and surveillance arrangements for all their expatriate and indigenous workers. Aside from such arrangements, these companies have updated contingency plans and evacuation procedures for said workers in the event of emergencies cropping up.

3. The Delta Region is far from Lagos and Abuja, the financial and political centers of the country. It is also far from other major urban centers like Ibadan, Benin, Abeokuta, Aba, in the south and Kano, Kaduna, Sokoto, Maiduguri, Ilorin, in the north. These places are homes to big communities of OFWs and their dependents - are peaceful and quite; daily life and business activities go on normally. True, there are social problems therein, but they are also the same problems that are in the Philippines and other countries, perhaps worse than what is in Nigeria.

4. The employment benefits of OFWs in Nigeria are far better and higher than those offered in the Philippines and in other countries. OFWs in Nigeria have made very positive impressions on their employers and are most likely to be re-hired. However, this current deployment ban will certainly affect such re-employment. Employers fully know that their Filipino workers can no longer return for employment because of this deployment ban. As a result, companies will source their skilled manpower requirements from other countries.

5. If we, OFWs in Nigeria who travel for home leave in the Philippines, are barred from returning to our employment, how can we meet our numerous financial commitments – monthly payments for mortgaged houses, children’s school fees, feeding for the family, water and electric bills, financial support for aged parents, etc?

Are there employment opportunities in the Philippines which can provide us far greater benefits than what we receive from our employers in Nigeria?

6. It is only the Philippine Government which has imposed travel restrictions on its citizens who seek for gainful employment in Nigeria. Other countries, whose citizens have been subject to much severe cases of abductions/kidnappings, issue travel advisories only. This situation makes us a laughing stock among the expatriate communities in Nigeria.

Protect Indigenous Peoples' Rights! Justice for Jordan Manda and Timuay Lucenio Manda

We condemn the attack on Subanen tribal chieftain Timuay Lucenio Manda, which has resulted in the death of his 11-year-old son Jordan Manda. We call on President Benigno Aquino and DILG Secretary Mar Roxas to investigate the ambush and bring the perpetrators to justice.

For the past three years, Timuay Manda has received death threats because of his refusal to give free prior and informed consent (FPIC) to mining and logging companies. He also joined the filing of a petition for the Writ of Kalikasan to protect the Pinukis Range Forest, which is included in the claims of several mining companies. Mt. Pinukis is considered a sacred mountain by the Subanen tribe.

We call on every one to give support to our indigenous brothers and sisters, who stand in the front lines to protect Mother Nature. We call on the Philippine government, especially the Philippine National Police (PNP), National Commission on Indigenous Peoples (NCIP), the Commission on Human Rights (CHR) and the Department of Interior and Local Government (DILG) to investigate the incident and bring the perpetrators to justice.

We call on President Benigno Aquino to protect the rights of Indigenous Peoples, and to hold mining companies accountable for their human rights abuses against IPs and other citizens. End the culture of impunity! Stop extra-judicial killings! Protect the rights and lives of Indigenous Peoples!
