Those monies should never be placed in an operating account prior to services rendered. The clause allowing the rental company to opt out from an audit is bad law. If I was a prospective renter, I would have to assume those opting out from auditing don't want their books audited for a reason. Why risk my money? If that business closes their doors, I would likely get nothing back.

Since the law was changed in 2003 numerous rental companies in Tennessee have gone out of business, leaving the guests and credit card companies out of luck trying to recover the advance deposits for future reservations that will not be honored.
