Petition to Conform Costa Mesa-issued ‘Public Entertainment Permit’ Noise Conditions to California’s Dept. of Alcoholic Beverage Control Licensed Premises Noise Conditions When the ABC has Applied Them, Unless the Municipal Noise Conditions are Stricter than the State levels.
The City of Costa Mesa issues “Public Entertainment Permits” to entities, including some that are licensed by the California Department of Alcoholic Beverage Control (the “ABC”). Some of these ABC licensees have specific conditions regarding sound and noise and are attached to the license as “Operating Restrictions.” When Costa Mesa Public Entertainment Permits and ABC “operating conditions” are not in conformity, permit and license holders, the public, and city staff and officials are confused as to which apply.
We, the undersigned, are concerned citizens who urge our leaders to act now to direct City Staff to conform City-issued “Public Entertainment Permit” noise conditions to California Department of Alcoholic Beverage Control issued sound-related “operating conditions”, unless the City’s noise conditioning in the ‘Public Entertainment Permit’ are stricter than state-imposed conditions. #costames #PEP2ABC
