1. A Development Application for the consolidation of Blocks 1 and 2 of Section 58 Kingston (corner of Printers Way and Waygoose Street) to vary the lease purpose was submitted to ACTPLA on 21 October 2009 and was refused because it did not comply with the legislated requirements for merit track applications. ACTPLA found that the application was inconsistent with: the relevant code , being the CZ5 Mixed Use Zone Development Code (CZ5 Code); and advice given by entities, the entities being Land Development Agency (LDA) and Territory and Municipal Services (TAMS).

2. An application for reconsideration was then made on 28 April 2010 and ACTPLA confirmed the original decision to refuse the application on 24 June 2010, having found that there were no grounds that would support an approval of the proposal.

3. The applicants then submitted an appeal to the ACT Civil and Administrative Appeals Tribunalon on 20 July 2010. The Hearing is scheduled for 19/20/21 October 2010.

4. If approved, the development application would join two blocks and allow for a four story multi apartment building to be built, completely out of character with the First Edition precinct and contrary to the development requirements for a stand-alone housing precinct.

We the undersigned state that we believe that developments within the First Edition Precinct should conform with:
- the intentions of the Lease and Development conditions;
- the First Edition Design Guidelines; and
- the intention of the nature of the development created by the Land Development Agency for the Precinct.

Specifically, that the Precinct be a single dwelling precinct of two stories (with limited third story elements) offering an alternative to apartment living that is available elsewhere; and with some blocks also allowing a small cultural facility limited to an art gallery or a small office.

I support the parties joined to Australian Capital Territory Civil and Administrative Tribunal proceedings AT10/59 and strongly believe the lease variation and block consolidation application by the applicants in the proceedings should be refused.
