RE: Senate Bill 852 Opposition Letter
Dear Senators:
I urge you to seize the opportunity to protect the health of your constituency by voting NO on S. 852, the Fairness in Asbestos Injury Resolution (FAIR) Act, legislation that further penalizes victims of asbestos-caused diseases.
The incidence of asbestos-related disease, including mesothelioma, lung cancer, and asbestosis, is exploding. Studies estimate that during the next decade, 100,000 victims in the United States will die of an asbestos-related disease - that's 30 deaths per day. Asbestos will claim more lives than skin cancer.
Asbestos diseases are debilitating and fatal. Victims of asbestos disease rarely return to work. Medical bills combined with loss of income leave families without recourse to compensation or resources to support the necessary care taking of loved ones.
S. 852 is unfair to present and future victims and their families, as:
*The trust fund is grossly under funded,
*Ineligibility of claims based on proof occupational exposure,
*Ineligibility of claims for environmental or unknown exposure,
*Compensation is not based on the merits of the case.
*Unconstitutionality disputes will delay victims' compensation,
*Lack of transparency,
*No opt-out clause for the victim,
*Inaccurate Medical Criteria,
*Insufficient funding for research, education, prevention and outreach,
*Extensive delays in processing victims' claims,
*Enormous administrative expenses.
As a concerned constituent, I urge you to vote NO on this unsalvageable bill.
