The Mayor of Wollondilly Shire Council is currently elected on an annual basis from amongst nine elected councillors. The ratepayers do not have a voice in the process.
In New South Wales, the method of electing the Mayor is set out in the Local Government Act 1993 and Local Government (General) Regulation 2005. The Mayor is elected in accordance with section 227 of the Act.
To alter the current position in which the Wollondilly Mayor is elected, a constitutional referendum must be held at a full general election in accordance with section 16 of the Local Government Act. State wide general elections will be held in September 2012.
If the referendum for a “yes” decision is endorsed at the general election, nominations for a popularly elected mayor will commence at the local government ordinary election in 2016.
We, the undersigned ratepayers and electors, call on Wollondilly Shire Council to investigate the feasibility of conducting a constitutional referendum for a POPULARLY ELECTED MAYOR at the forthcoming Local Government general election in September 2012 for the following reasons.
It should not be the decision of nine councilors to elect a mayor from amongst their numbers. It should be the democratic right of the electorate.
