The State of Tennessee conducts, almost weekly, roadblocks or what they like to call "checkpoints". This is a Civil Infraction of our rights.
At a sobriety checkpoint, drivers are necessarily stopped without reasonable suspicion, and may be tested summarily and without probable cause.
Jurisdictions that allow sobriety checkpoints often carve out specific exceptions to their normal civil protections, in order to allow sobriety checkpoints.
The Michigan Supreme Court had found sobriety roadblocks to be a violation of the Fourth Amendment. See Police v. Sitz (1990).
Although the U.S. Supreme Court has found sobriety checkpoints to be constitutionally permissible, eleven states have found that sobriety roadblocks violate their own state constitutions or have outlawed them.
We, the undersigned, call on the State of Tennessee to eliminate Roadblocks, (ie: Sobriety Checkpoints, Safety Checkpoints, License Plate Checkpoints, etc.) as we feel it is in violation of our Fourth Fourth Amendment Rights.
As Citizens of the State of Tennessee, we, the undersigned, have come together to eliminate this infringement of our rights.
